Tribal Dispute Resolution Procedure

To submit a complaint, please download and email the completed form to support@bigpictureloans.com or mail it to Big Picture Loans, LLC, P.O. Box 704, Watersmeet, MI 49969. Once received, we will review your complaint and provide an answer to your inquiry or propose a resolution to your complaint.


Big Picture Loans, LLC is regulated by the Tribal Financial Services Regulatory Authority (“Authority”), pursuant to the Tribal Consumer Financial Services Regulatory Code (“Code”). If you would like to contact the Authority for information and assistance related to the Code or regulations applicable to your loan or Big Picture Loans, LLC’s business operations, you may contact the Authority at the mailing address provided below.


Jurisdiction


Big Picture Loans reviews and approves all loans on Tribal land at its office located at E23970 Pow Wow Trail, Watersmeet, MI 49969. Accordingly, our customers and your loan agreement with Big Picture Loans are within the Tribe’s jurisdiction and exclusive authority to regulate. Under Section 7.2 of the Code, Big Picture Loans consents to the jurisdiction of the Tribal Court to resolve Consumer and Loan Applicant disputes where required by and in accordance with Tribal law.


Informal Dispute Resolution Procedure


If you believe Big Picture Loans has engaged in an unfair or deceptive act or practice in violation of the Code or applicable law, breached the terms of your loan agreement, or otherwise treated you unfairly, you may submit a complaint to Big Picture Loans in accordance with the complaint procedures set forth in your loan agreement.


Exhaustion of Tribal Remedies


You must exhaust all options in Tribal Court before you may bring any suit in any other court of competent jurisdiction. Claims that are outside the jurisdiction of the Tribal Court may be raised in any court of competent jurisdiction after exhaustion of these administrative procedures.


Tribal Court Procedures


If Big Picture Loans has proposed a resolution to your complaint and you are not satisfied with the resolution, you may file a complaint with the Tribal Court pursuant to Section 10.4 of the Code. Tribal Court procedures are limited to adjudication of Big Picture Loan’s compliance with the Code and applicable laws.


Your complaint will be handled in accordance with the Tribal Court’s rules, procedures, and orders. Following a hearing, the Court will issue a written decision and order within a reasonable time.

Either party may appeal the Tribal Court’s decision in accordance with the Tribal Court Rules. Following oral argument, the Tribal Appellate Court will issue an opinion and order. The Tribal Appellate Court’s decision is final and may not be appealed.

Upon issuance of a final decision following any appeal, a consumer will have exhausted the remedies available under this process.

An action or appeal under this process is not a suit against the Tribe, does not challenge the Tribe’s sovereignty, and cannot be used to circumvent the Tribe’s sovereignty.

This service is provided to you via the internet from the reservation of the Tribe, regardless of where you may be situated or access this site from and does not constitute an offer or solicitation for consumer loans in any state. If Big Picture Loans approves your loan, it will be governed by Tribal law, applicable federal law and your loan agreement. The laws of your resident state may have interest rate limits and other protective laws that are more favorable. If you wish to have your resident state’s law apply, you should consider taking a loan from a licensed lender in your state.

If your application is approved, we will attempt to send your funds using Real-Time Funding, which can provide instant funding, including on weekends. The exact time your funds appear in your account may vary depending on your bank’s processing times. If your bank does not accept Real-Time Funding, we will automatically send your funds by ACH, which usually posts the next business day (Monday through Friday excluding all federal banking holidays). Big Picture Loans does not charge a fee for Real-Time Funding; check with your banking institution regarding any fees they may charge.


Loan approval and amounts are based on minimum income amounts, other credit criteria, and verification of the information provided during the application process. Big Picture Loans, LLC (“Big Picture Loans ®”) will run credit checks on all applications. Availability of installment loans is subject to change from time to time as determined by Big Picture Loans.
